It' definitely easy to see that there are two sides to this argument. One, the automatic sploggers who you can't do anything about really and two, the lazy bloggers that are just looking for easy posts. These are two different animals. I think most of the time a legitimate site will take down something offending if you contact them about it.

I agree that just because you publish a full text feed doesn't automatically mean that you give rights to publish as well.

I've run across sites that have posted entire posts off Emergiblog - they definitely give me credit, but the person doesn't have to visit Emergiblog. Imagine my surprise when I see a link on technorati I don't recognize, go there and see my blog posts! I'd rather have the readers visit the blog itself than read it somewhere else!

That's definitely true, Shawn, but I haven't yet found another blogger who shares your opinion that unless the content is expressly copyrighted, that it's fair game. Most of us publish full-text feeds because it's what readers prefer, and while using an excerpt from those feeds could certainly be considered "fair use" in many cases, using the entire feed to provide content for your own affiliate site is definitely not something that most bloggers would be fine with. I would be very surprised if even 1% thought it was alright.

> I think Shawn is giving advice to legitimate wannabe affiliates, not sploggers in the making.

Correct - I have a great disdain for the scrapers and such.

But I see positives in people publishing the material I make available in my RSS feed.

It provides me with greater penetration, they are only able to display the excerpt I make available (about a paragraph or less), and there is a link to my full post.

That's just it, though. I think Shawn is giving advice to legitimate wannabe affiliates, not sploggers in the making. Sploggers are a fact of life, but I don't want aboveboard site owners to think it's okay to use my content without my permission.

Hi Shane,

I agree with the first comment - you do have copyright protection of any content published to your blog regardless of what distribution medium is used.

You could get a lawyer to confirm that, but I'm pretty confident that I'm right.

However I've come to expect my content to be scrapped many times on many splogs shortly after publishing.

Initially I wanted to take it down and I know if I eventually issued a DMCA to the hosting ISP I could get them taken down. However it's not a productive activity for me, and considering most splogs publish everything I write, including my affiliate links, in some ways they are helping me reach a slightly larger audience.

It's not a clear cut issue and each blogger has to deal with it in whatever way they feel comfortable.

If you want more details on what to do if someone steals content, try this performancing link - http://performancing.com/node/4482

Cheers,

Yeah, what is more crazy is this post was picked up by a splog not less than 10 min after you posted it. http:// www. goodsearchengine. com/blog/ -

Unless rights are explicitly stated, RSS is not up for grabs. Even Creative Commons have conditions (non-commercial, attribution, content has to remain CC).

Though a copyright notice is as effective on sploggers as RIAA's lawsuite threats on 12 year old music enthusiasts. If you publish content, it could be copied/pasted, screen scraped, etc. RSS just makes it easier ;)
